L1 Visa

To be eligible for L-1 petition and L-1 visa, both the employer and the visa applicant have to be able to meet the specific eligibility requirements outlined below.
In order for the employer (petitioner) to be eligible to apply, the below requirements have to be met.

L-1 Petition requirements:

• Qualifying relationship between the foreign and the US organization should be in place such as – parent, sister or daughter company, branch, subsidiary or affiliate;
• There must be an operating US entity in place or one will be established soon (physical premises must be in place).

L-1 Blanket Petition requirements:

• The US office should have been operating for at least 12 months prior to the application;
• The company has three or more US or foreign branches;
• The company should meet at least one of the below requirements:
  • Have been approved at least 10 L-1 applications in the last 12 months;
  • Have realized combined sales in the US branches equivalent to min $25 million;
  • Have at least 1000 US employees.

L-1 Visa requirements:

To be eligible to apply for L-1 visa, the visa applicant:

• Should have been employed by the sending organization for at least 12 months prior to the transfer;
• Should be on a managerial position or possess key knowledge in regards to the business;
• Should have qualifications relevant to a bachelor’s degree or have sufficient experience relevant to a degree (3 years of experience are relevant to 1 year of qualifications).
